Consumer Health Data Privacy Notice

This Consumer Health Data Privacy Notice (“Notice”) applies only in limited circumstances when FFF, together with its subsidiaries and affiliates (collectively, “FFF,” “us,” “we,” or “our”) may handle health information subject to the Washington My Health My Data Act (“Consumer Health Data”). This Notice does not apply to most health data we handle, which is instead subject to the Health Insurance Portability and Accountability Act (“HIPAA”) as described in our main Privacy Statement. This Notice also does not apply to data about our own employees, contractors, agents, or job applicants, and does not apply to data that we handle as a “processor” on behalf of our business customers (in which case our business customers (not FFF) control how your information is handled).

Changes: We may update this Notice from time to time. Any updated Notice will be effective when posted. Please check this Notice periodically for updates.

1. Sources of Consumer Health Data

We collect Consumer Health Data directly from you when you subscribe to IG Living magazine, sign up for newsletters and email communications, leave comments on blog posts, or otherwise send us communications that contain your health information (such as if you choose to “share your story”).

2. Types of Consumer Health Data We Collect

We may collect the Consumer Health Data you choose to provide, such as health conditions, diagnoses, diseases, or treatment information. We may also infer Consumer Health Data derived from information you choose to provide.

3. How We Use Consumer Health Data

We may use Consumer Health Data for the following purposes:

• To provide you services you request (and related business functions), such as to provide you with a subscription to the IG Living magazine and personalized email communications if you sign up, to determine the topics and content of blog posts we make available to you (which may be selected based on aggregating health information that individuals choose to provide to identify common issues), and for other functions related to services or information you request. We may also use such data for related business functions, such as providing customer service and communicating with you (including soliciting feedback or responding to requests, complaints, and inquiries); maintaining and otherwise facilitating your relationship with us; and evaluating and improving the products and services you request.

• For legal, safety or security reasons, such as complying with legal, reporting, and similar requirements; investigating and responding to claims against us, our personnel, and our customers; for the establishment, exercise or defense of legal claims; protecting our, your, our customers’, and other third parties’ safety, property or rights; detecting, preventing, and responding to security incidents and health and safety issues (including managing spread of communicable diseases); and protecting against malicious, deceptive, fraudulent, or illegal activity.

• In connection with a corporate transaction, such as if we acquire assets of another business, or sell or transfer all or a portion of our business or assets including through a sale in connection with bankruptcy and other forms of corporate change.

• For other uses with your consent.

We may use anonymized, de-identified, or aggregated information for any purpose permitted by law.

4. How We Disclose Consumer Health Data

We disclose the Consumer Health Data described above to third parties, including the categories of recipients described below:

• Affiliates and subsidiaries, including parent entities, corporate affiliates, subsidiaries, business units, and other companies that share common ownership, including Nufactor, Inc., MinibarRx, LLC dba RightNow Inventory Product Management Solutions, InCircle LLC, and KlearTrust Corporation.

• Service providers that perform functions on our behalf related to the products and services you request (including our newsletter and email communications), such as cloud services, security services, data storage, website hosting, professional consulting, and other support functions.

• Law enforcement, government agencies, and other recipients for legal, security, or safety purposes, such as when we share information to comply with law or legal requirements, to enforce or apply our Terms of Service and other agreements or policies, and to protect our, our customers’, or third parties' safety, property, or rights.

• Other entities in connection with a corporate transaction, such as if we acquire assets of another entity, or sell or transfer all or a portion of our business or assets including through a sale in connection with bankruptcy and other forms of corporate change.

• Entities to which you have consented to the disclosure.

5. Data Subject Rights

Washington consumers may have certain rights regarding your Consumer Health Data:

Right to Access. You may have the right to confirm whether we process your Consumer Health Data and to obtain information about how we process such data.

Right to Delete. You may have the right to request that we delete Consumer Health Data concerning you.

Right to Withdraw Consent. If you provided consent to process Consumer Health Data, you may have the right to withdraw such consent.
